  1. Purposes:

Scope of Work for Hiring a Longer-term Legal Consultant for Professional Legal Services

 

  1. CONTEXT:

Catholic Relief Services is the official international humanitarian agency of the Catholic community in the United States. CRS works to save, protect, and transform lives in need in more than 100 countries, without regard to race, religion or nationality. CRS’ relief and development work are accomplished through programs of emergency response, HIV, health, agriculture, education, microfinance and peacebuilding. 

 

  1. SCOPE OF WORK:

The legal Advisor/consultant will be reporting to the Country Representative and/or any other designated person from CRS, to assist the Agency in legal subjects related to its work operation in Sudan.

  1. The legal Advisor shall be the authorized Legal Advisor for CRS Sudan and render legal services to the Agency in Sudan.  
  2. The legal Advisor shall perform the duties diligently and faithfully, according to the legal profession, by providing the following services among others:
  1. Legal Advice and Consultancy.
  2. Legal assistance in matters related to the operation of the Agency in Sudan.
  3. Legal assistance in all matters concerning smooth and legal operations of the Agency, e.g. Employment contracts and benefits, operational contract and any other contracts, relationship with HAC and any other governmental concerned bodies ...etc.
  4. Challenging any legal action brought against the Agency before courts of law and any other authority, as well as representing the Agency before courts of law and any other legal organs.
  5. Making sure that all the operation of the Agency is in accordance with the Sudanese laws.
  6. Assisting legally and advising on issues and problems with HAC and other concerned bodies, institutions and individuals.
  7. Helping in the establishment processes of regulatory policies in the organization with all its aspects.
  1. The Agency agrees to pay the Legal Advisor a fixed amount agreed upon, as monthly retainer fee.
  2. While travelling outside the country office, the Agency shall provide the legal Advisor transport, accommodation and feeding and daily per diem agreed upon will be paid while on overnight travels. Travels shall be agreed in advance by the Agency and the Legal Advisor.
  3. The Agency agrees to pay the Advisor an additional amount for any other professional work mutually agreed upon in advance not included in Article 3 of this contract items from I. to VII.
  4. As of article IV. The Agency agrees to pay additional amounts in events of court cases or legal actions against CRS; the additional amounts will be mutually agreed upon between the two parties’ case by case.
  5. The legal Advisor agrees to be available for the Agency to fulfill the duties diligently and faithfully, according to the legal profession.
  6. Either party may terminate the contract, without penalty on either side, giving the other party one-month notice.

  1. DESCRIPTION OF THE EXPECTED SERVICE:

The legal Advisory support is an important and critical requirement within any organization. It is expected to have defined roles and responsibilities for the legal advisor (whether an individual consultant or a legal Firm) for managing legal, litigated and regulated issues to avoid any complexity raised by the regulatory authority as well get rid of from any legal punishment. This legal Advisor will give us the ability to manage all organizational regulatory obligations for managing CRS Sudan staffs, dealing with third parties, e.g. partner’s, suppliers, consultant, e.tc and legal backstopping CRS Sudan to be compliant with legislative requirement in CRS correspondences with different govt. authorities and other stakeholders. In collaboration with Country Representatives, the consultant will ensure the legal protection and safeguarding of the organization by providing legal support in the area of employment law, income tax law, social security law or the reinforcement of the framework of delegations and Internal Control of the organization.

Minimum requirements: Invited Lawyers should submit their quotation for the service outlining the following minimum requirements.

a.            Price quotation (in USD) for the Service (Service Price)

b.            Capacity statement of the entity who will be leading this legal Service providing CV and work experience certificates.

2.            Deadline: Offer deadline for this service is July. 14, 2020 at 4:00pm Sudan time.
